Performance by Javier's Tree Service LLC:
Work crews shall arrive at the job site unannounced unless otherwise noted herein. Javier's Tree Service LLC shall attempt to meet all performance dates, but shall not be liable for damages due to delays from inclement weather or other causes beyond our control.
Workmanship:
All work will be performed professionally by experienced personnel outfitted with the appropriate tools and equipment to complete the job properly. Unless otherwise indicated herein, Javier's Tree Service LLC will not remove wood, brush and debris incident to the work. Yard damages, such as ruts and divots are incidental, and an attempt to avoid them will only occur if specified, and agreed upon.
There is no guarantee that yard damage, such as ruts or divots, can be prevented, even if an attempt has been made to avoid it. Javier's Tree Service LLC will not be liable for the damages described above.
Insurance:
Javier's Tree Service LLC is insured for liability resulting from injury to persons or property, and all its employees are covered by Workers Compensation Insurance, to the extent required by law.
Ownership:
The customer warrants that all trees, plant material and property upon which work is to be performed are either owned by him/her or that permision for the work has been obtained from the owner. Javier's Tree Service LLC is to be held harmless from all claims for damages resulting from the customer's failure to obtain such permission.
Terms of Payment:
All accounts are net payable upon receipt of the invoice. A service charge of 1.5% will be added to accounts not fully paid 30 days subsequent to the invoice date.
If outside assistance is used to collect the account, the customer is responsible for all costs associated with the collection, including, but not limited to, attorney fees and court costs.
A 3% fee will be applied to any payments made by Credit Card.
Fenses:
If fenses need to be removed, to perform service, the fense service wil be performed by the customer. In some cases Javier's Tree Service LLC may assist in the subcontracting of a fencing company. All costs of a subcontracted or directly contracted fensing company will be payed for by the customer. Javier's Tree Service LLC assumes no liability for any damages incurred to property from the fense removal.
Stump Grinding:
Although every reasonable precaution will be taken (including contacting the utility locating service), Javier's Tree Service LLC assumes no responsibility or liability for damage to, or damages resulting from damage to, underground pipes, wires, utilities, strucutures, etc. occurring during stump grinding operations unless their exact location is indicated by the client prior to the performance of work.
Stump grinding does not guarantee the possibility of another tree to be planted in it's place.
Estimates:
Estimates are just that, Estimates. Educated guesses based on the information at hand at the time provided. Estimates are subject to change at any given time. Javier's Tree Service LLC will not be held responsible to providing service at an estimated price, if conditions change.
Multimedia:
Multimedia, such as photos or videos will be used for customer service, advertising and or legal reasons.
Reservation of Right To Amend:
Javier's Tree Service LLC reserves the right to amend these terms and conditions at anytime either verbally or written.
